ROGER G. BOWERS
Roger has overseen hundreds of real estate transactions, from single and multi-family residential and commercial closings for individual properties to portfolio acquisitions and dispositions of scores of properties. Most recently, he simultaneously closed a portfolio of self-storage facilities, oversaw the sale of a business through a real and personal property asset transfer and orchestrated the coordination of design initiatives on two different adaptive renovations. He has worked extensively to put private and public real estate finance in place, including traditional lender financing, private placements, tax favored bond transactions, historic and enterprise zone tax credit structures, coordination of assets for initial and secondary public offerings and sale-leaseback and synthetic lease financings. Roger has represented both landlords and tenants in all kinds and sizes of leases, work letters and flexible space usage. He has counseled clients in operations and purchasing departments, including purchase order terms and conditions, equipment leasing, consulting, agency and confidentiality agreements. An important part of Roger's development experience is an integral knowledge of how the design and construction process works for commercial, industrial, retail and residential projects. He drafts and negotiates contracts for development, project management, design, design/build, construction, subcontracts, agents and consultants. Through extensive involvement with negotiating the general terms and conditions of the American Institute of Architects and other form document sets, he has a firm understanding of the practical realities of complex construction and can look beyond to the practical realities of getting the project built. He understands and emphasizes the importance of good project management and good contracts as a catalyst for keeping projects on their critical path. Prior to practicing real estate law, Roger worked in title research, surveying, construction and project management. He has laid out subdivisions, worked as a professional carpenter, coordinated contractors and shepherded development project through the regulatory approval process. He was a consultant to local government, implementing the transition to geographic information system mapping and data collection that is now central to most planning and land use development. Roger is an active participant in real estate projects, finding solutions for the participants in deals even when there are long odds of success. He is practical and realistic in analyzing, advising about and negotiating all aspects of land acquisition, development and disposition; seeking common ground while keeping strictly within the business and legal constraints identified as vital to his clients interests.
